THE RAFFLE: Meals on Wheels of Greater Lynchburg (MOW), a 501(c)(3) nonprofit organized under the laws of the Commonwealth of Virginia, is conducting a destination raffle. Winners will receive accommodations, amenities and benefits listed on the website at the time of the drawing. While the prizes may be referred to as 'trips,' no transportation to or from the destination is included, except as listed with the descriptions. Winners must provide his/her own transportation to the destinations. The raffle is governed by the Commonwealth of Virginia’s Office of Charitable and Regulatory Programs.
HOW TO ENTER: Go to wheelsuplynchburg.org and click on the link to purchase the Raffle ticket(s). Complete the purchase by filling out the entry information requested, i.e., email address, first and last name, birthday, home address, and phone number, and paying the non-refundable ticket price. Tickets must be filled out in the name of a single-individual. There is no limit to the number of tickets an individual may purchase. A donation to MOW will not increase your odds of winning.
Tickets can be purchased in person or online via the MOW website, www.wheelsuplyh.org, payable by credit card, beginning September 1, 2020 through 12:00PM EDT Wednesday, September 30, 2020. Additional raffle tickets may be purchased in person from MOW up until 3:00PM EDT on the drawing date.
The purchase price for one raffle ticket is $110. All entry purchases are final and non-refundable.
One hundred (100) raffle tickets are available to be sold for each destination. Once 100 tickets are sold, raffle sales will be discontinued for that location.
Odds of winning depend upon the number of eligible entries.
ELIGIBILITY: Anyone purchasing a raffle ticket agrees to be bound by the following rules and restrictions. Additionally, by purchasing a ticket, the entrant certifies that they are 18 years of age or older. No tickets will be sold to persons who have not reached the age of 18 as of Wednesday, September 30, 2020, the date of the drawing. MOW employees and their immediate families are not eligible to win
The name associated with the ticket stub will be deemed the winner if the ticket is selected in the drawing. Any unsold tickets at the time of the drawing will be voided. Ticket stubs and unsold tickets will be maintained in the possession of MOW for a period of three (3) years.

SELECTION OF WINNER, NOTIFICATION, AND ACCEPTANCE: The winner of the raffle will be determined by random drawing. The winner of the raffle will be announced immediately upon drawing, held on September 30, 2020 at approximately 7:30PM EST. The winning information will be posted on the WheelsUp! and the MOW websites (www.wheelsuplynchburg.org, and www.mealsonwheelslynchburg.org). MOW also reserves the right to post the winning information on our social media sites (Facebook and Instagram). Purchasers do not need to be present to win and will be contacted via email and/or phone within 3 business days.
Winner agrees to all raffle rules and restrictions as stated herein and posted on our website, as well as any rules printed on the ticket. Winner agrees to allow MOW to publish their name and photograph(s) on the WheelsUp! and MOW websites, and social media sites (Facebook and Instagram).
Winner will assume and be responsible for all Federal, State and Local taxes, including but not limited to all applicable sales, use, luxury, income, and special taxes associated with winning a raffle. MOW specifically disclaims all expressed or implied warranties, including, and without limitations, warranties of merchantability.
The raffle winner must claim the prize within thirty (30) days of the drawing. If the winner does not claim the prize within thirty (30) days of the drawing, by responding to telephonic, email or other written notice from MOW or otherwise, or the prize is refused by the winner, the prize will be forfeited and the total proceeds raised through the sale of the raffle tickets shall remain the property of MOW, and used to fulfill its exempt purpose.
If more than one name is noted as purchaser of a ticket, the first listed name shall be the purchaser. MOW shall, will and can have no obligation for payment or delivery of any prize to any person other than the purchaser. It is the sole responsibility of the purchaser to allocate any such prize among the participants in any multiple party entries.
PARTICIPATION DISCLAIMER: By entering this Raffle, the winner agrees to be bound by these Rules of Play and assumes all liability for any injury or damages caused or claimed to be caused by participation in the Raffle and/or the acceptance and/or use of any Prize and release the Sponsor and each of its respective owners, affiliates, officers, directors and employees, from any such liability. Entry constitutes permission (except where prohibited by law) to use winner’s name and address for purposes of advertising promotion and publicity without compensation. The winner is solely responsible for reporting and payment of any taxes on the Prize. The Sponsor assumes no responsibility for the winner’s tax obligations and suggests the winner consult a tax advisor.
Any drawing may be postponed due to weather or any state of emergency declared by the Governor of Virginia, or the President of the United States. In such event, a new date, place and time for the drawing will be determined by MOW, which will be announced on MOW's website and in social media.
CLAIMS, DISPUTES, AND LIABILITY: As described above, if a dispute arises regarding who submitted an entry, the entry will be deemed submitted by the person in whose name the entry was made.
By entering this Raffle, each entrant agrees that (i) any and all disputes, claims, and causes of action arising out of or in connection with this Raffle, the drawing or the Prize awarded, shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs, directly or indirectly associated with entering this Raffle, but in no event will attorneys’ fees be awarded or recoverable; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby knowingly and expressly waives all rights to, any damages other than actual out-of-pocket expenses.
The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. In no event shall the Sponsor be liable for any consequential, special, indirect, incidental or punitive damages, even if it has been advised of the possibility of the damages.
If, for any reason the Raffle is not capable of being conducted as planned due to any cause beyond the control of Sponsor, including but not limited to any event or cause which corrupts or affects the administration, security, fairness, integrity or proper conduct of the promotion, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Raffle and disqualify any individual who may have caused any such problem. Sponsor assumes no responsibility for any theft or destruction, unauthorized access to, or alteration of entries. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to, or alteration of entries. Sponsor is not responsible for any problem or technical malfunctions of any telephone network or lines, computer online systems, servers or provider, computer equipment, software, failure of any entry to be received by Sponsor on account of technical problems or delays, including any injury or damage to participant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Raffle. Any attempt by any person to deliberately damage the website or undermine the legitimate operations of the Raffle is in violation of criminal and civil law and should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.
Any and all disputes, claims and controversies concerning this raffle shall be submitted to and resolved by binding arbitration, to be conducted under arbitration rules in the Commonwealth of Virginia.
This Raffle is not intended to be used for gambling purposes. If it is determined that a participant is using the Raffle for gambling purposes, he/she will be disqualified.
